Insolvency practitioners: avenues of accountability

IPs carry out a number of functions when dealing with troubled companies and, if they are to command support from those with interests in the company, it is necessary that they can, inter alia, claim to be held to account for their execution of these functions. Accountability claims differ from function to function yet many contributions to the IPs' accountability debate have tended to take an across the board approach. It is, nevertheless, possible to analyse IP accountability with reference to different activities and this mode of analysis both reframes discussions regarding IP regulation and offers a newly productive perspective of potential reforms of the control regime – as can be demonstrated by considering three currently mooted changes to constraints over IPs
