Hartley, T. C.
(2004).
Human rights as a bar to enforcement of a foreign judgment.
Law Quarterly Review,
120(Apr), 211-214.
Examines the Court of Appeal ruling in United States v Montgomery on the registration and enforcement of a confiscation order made by a US Federal District Court. Considers whether the proceedings in the US were contrary to the European Convention on Human Rights 1950 Art.6 and whether that meant that the order could not be enforced in England.
